Conviction Reversed In Hauppauge Sword Killing

(08/12/10) WOODBURY - The Appellate Division of the New York State Supreme Court has overturned the murder conviction in the 2005 samurai sword killing in Hauppauge.

Zachary Gibian, 23, was convicted of second-degree murder for slaying his stepfather, Scott Nager, and sentenced to 25 years to life. At the time of the sentencing, Gibian had maintained that his mother was the one responsible.

According to the appellate court, the judge in Gibian's trial wrongly prevented the defendant from testifying about statements his mother had allegedly made and failed to investigate alleged jury misconduct. The panel also found that the judge interrupted the closing statement of Gibian's attorney.

The decision to overturn Gibian's conviction was not unanimous, with one judge dissenting.

Gibian's case will be remitted to the Supreme Court of Suffolk County for a new trial.
